  • 1. SCOPE OF SERVICES

    The Contractor agrees to provide aerial services as detailed in the attached Statement of Work (SOW).

    2. REGULATORY COMPLIANCE (2026 UK STANDARDS)

    • Authorisation: All flights will be conducted under the Contractor’s CAA Operational Authorisation (OA) and in full compliance with the 2026 UK UAS Regulations.

    • Identification: The Contractor warrants that all aircraft used are equipped with active Direct Remote ID (RID) and display a valid UK Class Mark (UK1-UK6) or meet equivalent legacy transitional requirements.

    • Authority: The Pilot in Command (PIC) retains absolute authority regarding flight safety. The PIC may abort or modify operations at any time due to weather, technical failure, or safety risks.

    3. INTELLECTUAL PROPERTY & DATA OWNERSHIP

    • Raw Data: The Contractor retains all Intellectual Property (IP) and title to the Raw Data

    • Deliverables: Upon receipt of full payment, the Contractor grants the Client a non-exclusive, perpetual, royalty-free license to use the Final Deliverables for the specified project.

    • Data Security: Data will be processed and stored using encrypted cloud infrastructure, maintaining a high level of data integrity.

    4. FEES & PAYMENT

    • Payment Terms: Invoices are payable within 14 days of the date of the invoice.

    • Weather Cancellation: If a mission is canceled on-site due to weather exceeding safe operational limits (as defined in the Ops Manual), a Mobilization Fee of 50% of the day rate applies. One reschedule will be offered at no additional cost if canceled 24 hours prior to deployment.

    5. INDEMNITY & LIMITATION OF LIABILITY

    • Insurance: The Contractor maintains £10,000,000 Public Liability Insurance (compliant with EU EC 785/2004 as adopted in UK law).

    • Cap on Liability: The Contractor’s total liability to the Client for any claim arising under this Agreement shall be limited to the total amount of insurance coverage held.

    • Client Indemnity: The Client shall ensure all necessary land-owner permissions for take-off and landing are secured and shall indemnify the Contractor against any claims for trespass or privacy infringement resulting from Client-directed flight paths.

    6. DATA PROTECTION (UK GDPR)

    The Contractor acts as a Data Processor for any personal data captured during flight (e.g., identifiable persons or vehicle registrations). Data will be handled in accordance with the UK Data Protection Act 2018.

    At SE London Aerial Survey, we treat geospatial and visual data with the same technical rigor as financial cloud infrastructure. This policy explains how we collect, process, and protect data during our drone operations (Roof Inspections, LiDAR, and Photogrammetry) across London, South England, and Yorkshire.

    1. WHO WE ARE

    SE London Aerial Survey is the "Data Controller" for information collected via our website and the "Data Processor" for technical data captured on behalf of our clients.

    2. TYPES OF DATA WE COLLECT

    • Client Data: Names, emails, and site addresses provided via our contact forms for the purpose of quoting and contract fulfillment.

    • Primary Aerial Data: High-resolution imagery, LiDAR point clouds, and thermal data captured specifically for a client's asset (e.g., a roof or archaeological site).

    • Collateral Data: Incidental capture of uninvolved persons, vehicles, or private property in the vicinity of a flight path.

    3. LAWFUL BASIS FOR PROCESSING

    • Contractual Necessity: To deliver the reports and data models requested by our clients.

    • Legitimate Interests: To ensure the safety of our flight operations and to maintain records for CAA compliance.

    • Legal Obligation: Maintaining flight logs and pilot records as required by the Civil Aviation Authority (CAA).

    4. PRIVACY BY DESIGN & 2026 COMPLIANCE

    As a professional UAS operator, we utilize "Privacy by Design" to minimize data intrusion:

    • Remote ID Compliance: Our Matrice 300 RTK and Matrice 4 Enterprise broadcast Direct Remote ID (RID) in accordance with 2026 UK regulations, ensuring operational transparency.

    • Data Minimization: We only trigger sensors (Camera/LiDAR) when over the target area.

    • Redaction: Where incidental personal data (e.g., a face or a car registration) is captured and is not required for the technical report, we utilize software-based blurring prior to final delivery.

    5. DATA SECURITY & STORAGE (THE "ENGINEERING STANDARD")

    Leveraging our background in cloud infrastructure, your data is handled using industry-leading security protocols:

    • Encryption: All data is encrypted at rest and in transit using AES-256 standards.

    • Secure Transfer: Deliverables are provided via secure, authenticated cloud portals—never via unencrypted public links.

    • Hardware Isolation: Flight logs and raw data are purged from flight controllers and SD cards immediately after secure ingestion into our primary processing environment.

    6. DATA RETENTION

    • Flight Logs: Retained for 2 years as per CAA requirements.

    • Raw Geospatial Data: Typically retained for 6 months to allow for client re-processing requests, after which it is securely deleted unless otherwise agreed in the contract.

    • Final Reports: Retained for 5 years to assist clients with long-term asset management.

    7. YOUR RIGHTS

    Under UK law, you have the right to:

    • Access: Request a copy of the data we hold about you or your property.

    • Rectification: Ask us to correct inaccurate data.

    • Erasure: Request the deletion of collateral data where it is no longer required for its original purpose.
